GDPR & Privacy

Your privacy is guaranteed by the GDPR (General Data Protection Regulation). This law protects your personal data and determines, among other things, that you must give consent to request or pass on data to third parties (for example, to your child's teacher or a research institution).

Naturally, we handle confidential information with the utmost care. We always ask for your consent beforehand to send a report with detailed research and treatment data or to hold a (telephone) consultation. These data are only sent by email or post with your explicit consent.

Information on the processing of your personal data in our practice

What data do we collect about you?

  • Identification data (and, where applicable, of your legal representative);
  • Health insurance fund and membership details;
  • National registration number (Rijksregisternummer);
  • Data about your health (diagnosis, prognosis, anamnesis, treatment, ...);
  • Data about your family members, only if relevant for the speech therapy treatment;
  • Data about education and training of the person concerned;
  • Audio or video recordings (solely used for therapeutic and diagnostic purposes);
  • Any financial data regarding billing.

Why do we collect this data?

We collect this data to provide you with adequate and high-quality speech therapy care, to bill for our speech therapy services (to the RIZIV and possibly to you), and to follow up on any complaints or claims.

The data is collected and stored based on the treatment relationship that exists between you and us as a speech therapist (a medical treatment agreement), because we are legally obliged to do so, because it is necessary to protect your vital interests or our legitimate interest, or based on your explicit consent for that storage and collection.

Data about your health is specifically kept because this is necessary to provide you with speech therapy care. In the exceptional case where a patient has a complaint or damage claim, we also need to process health data to adequately follow up on and defend the complaint or damage claim.

When we process your data to protect our legitimate interest, it concerns the protection of our safety and our rights of defense.

Is the data shared with others?

In principle, the data we have about you is covered by professional secrecy. We therefore only share it with others when legally permitted, such as:

  • If this is necessary for good care provision (for example, with other healthcare providers, such as your GP, with the CLB, with your legal representative, ...);
  • If we are obliged to do so on the basis of regulations or case law (for example, with the government or the health insurance fund);
  • For the follow-up and handling of any complaints and claims (insurance broker, insurer, judicial authorities, ...);
  • When you have explicitly consented (for example, communication to a family member who is not a representative, to a friend, ...).

How long is my data stored?

We are legally required to keep your speech therapy file for up to 30 years after the termination of the treatment relationship. This means that we archive your data securely during this period.

Are there specific rights you can exercise?

As a patient, you can exercise various rights regarding the data we keep about you:

  • Right of access to and a copy of the patient file;
  • Right to rectify incorrect or incomplete data;
  • Right to withdraw any consent for specific optional processing at any time (the core of the file is, however, stored on the basis of the treatment relationship and legal obligations, and not on the basis of a revocable consent);
  • Right to lodge a complaint with the Data Protection Authority (GBA) if you believe that your privacy rights have been violated.

Who is responsible for the collection and storage?

The person responsible for collecting your data in the speech therapy patient file is your individual treating speech therapist, who records all data in the file. The ultimately responsible party for the secure storage thereof is the speech therapy practice: Logopedische praktijk Lieve Mutton, Platte Lostraat 580 A, 3010 Kessel-Lo.
